Consultation description
The Local Government Act (Northern Ireland) 2014 (“the 2014 Act”) makes provision for payment of compensation for loss of office or diminution of emoluments which is attributable to any provision made as a result of the reform of local government. Section 123(2) provides for the Department to make regulations under Article 19 of the Superannuation (Northern Ireland) Order 1972 (the 1972 Order) for the purpose of the payment of compensation in respect of diminution of emoluments.
The Department of the Environment is seeking comments on its proposal to make the Local Government Reorganisation (Compensation for Diminution of Emoluments) Regulations (Northern Ireland) 2015, under Article 19 of the 1972 Order. The purpose of the proposed regulations is to provide a specified period of protection to a person who suffers diminution of emoluments as a consequence of local government reorganisation in Northern Ireland. If circumstances should arise where a person transfers to a new post that would result in a reduction of remuneration from that received in their previous post, then a specified period of remuneration protection shall be applied.
